Email from Nick Dowling to Bexley council

Dear Customer Services,

I would like to make a formal complaint about the conduct of Akin Alabi the Head of Legal Services and the Monitoring Officer at Bexley Council.

I wish to complain bout the fact that he failed to meet the target date that he himself set for dealing with my complaint about Bexley Council breaking the law by not having an up to date copy of its own Constitution for me to view when I came to the Civic Offices on 21st March 2013 which he had set to address by 5th April 2013. I therefore feel that he has deliberately mislead me that the matter would be resolved by this date when it transpired that he was actually unable do so; and as such he has effectively lied to me – a gross dereliction of duty and a definite misconduct matter. Additionally, he then compounded the matter by failing to provide any reason whatsoever for his abject failure to meet the aforementioned self-imposed target. Once again demonstrating a highly unprofessional approach to his work and a casualness to the nature of the allegation that beggars belief from somebody of his evident stature as the Head of Legal Services and the Monitoring Officer at Bexley Council.

With regards to this failure to provide an explanation he made no attempt to provide any mitigation preferring to supply a comment that bore no relation to my complaint or allegation of law breaking by Bexley Council at all. This behaviour was crass and further demonstrated a totally inadequate and inappropriate level of action or apparent concern for the seriousness of my allegations - a further dereliction of duty and misconduct that clearly needs to be remedied as soon as possible. Despite the seriousness of evidenced law breaking by Bexley Council he has taken no opportunity to dispute any of my claims or concerns and failed to address any of the issues I had raised on 21st March 2013.

I would be most grateful if the following could now be actioned for me:


1) I would like Mr. Alabi to give me a meaningful explanation for why he was unable to meet his own deadline? (By return, please or provide an immediate explanation to me why he will be unable to do so.)
2) I would also ask that I be supplied immediately with details of precisely what he has done so far? Please also supply supporting evidence to substantiate any claims.
3) I would also ask that all officer time allocated to this matter so far be indicated to me as well.
4) I would then like to be told what is still outstanding to establish in order to deal with my complaint and be provided with a full and substantiated account of exactly what he has established in the matter to date.
5) If no detail can be supplied to me I want a full explanation for why not?
6) I am also keen for it to be indicated to me why I was informed at the last possible moment in Mr. Alabi’s own timeframe for dealing with this complaint. How come after two weeks of considering the matter he only realised at 8 p.m. on the final day that he would be unable to keep his word to me? This seems rather remiss and I would like him to fully explain why this circumstance came about – if he has not already addressed this point in his earlier correspondence as per the above.
7) Given Mr. Alabi’s apparent failure to take my allegations of law breaking seriously and deal quickly or adequately with them I wish to report him to any professional body that he is a member of in order to facilitate or fulfil his role as Head of Legal Services or Monitoring Officer at Bexley Council. To this end, please can I be supplied with the relevant details for any of these?
